Guests acknowledge that THE CIGAR CRUISE, LLC; DBA THE CIGAR CRUISE, LLC; DBA THE CIGAR CRUISE; DBA THE ROCKY PATEL CRUISE; DBA BASH AND BURN: is not the agent of and has no right to exercise control over the actions or decisions of (1) The Naples Beach Hotel & Golf Club or any of its agents, employees or independent contractors, or (2) any of the sponsoring manufacturers or purveyors of cigars or related devices, or (3) of any of its celebrity or invited guests, or of (4) The Naples Princess or any of its agents, employees or independent contractors.
Guests also agree that, in consideration of THE CIGAR CRUISE, LLC; DBA BASH & BURN furnishing its services, THE CIGAR CRUISE, LLC; DBA BASH & BURN SHALL NOT BE LIABLE FOR ANY LOSS, COST, DAMAGE OR EXPENSE OF ANY KIND, INCLUDING SPECIAL, CONSEQUENTIAL AND INCIDENTAL DAMAGES ARISING OUT OF THE PERFORMANCE OR NON-PERFORMANCE OF ANY ACT BY THE NAPLES BEACH HOTEL & GOLF CLUB, THE SPONSORING MANUFACTURERS OR PURVEYORS OF CIGARS OR RELATED DEVICES OR ANY OF THE CIGAR CRUISE, LLC; DBA BASH & BURN CELEBRITY OR INVITED GUESTS.
This agreement shall be governed by the laws of the state of Missouri. Except as provided below, it is agreed by and between the Guest and THE CIGAR CRUISE, LLC; DBA BASH & BURN that all disputes and matters whatsoever arising under, in connection with or incident to this Contract, shall be litigated, if at all, before the United States District Court for the Western District of Missouri in Kansas City, or as to those lawsuits to which the Federal Courts of the United States lack subject matter jurisdiction, before a court located in Jackson county, Missouri, U.S.A. to the exclusion of the Courts of any other county, state or country.
Any and all disputes, claims, or controversies whatsoever, whether brought in personal or in rem or based on contract, tort, statutory, constitutional or other legal rights, including but not limited to alleged violation of civil rights, discrimination, consumer or privacy laws, or for any losses, damages or expenses, relating to or in any way arising out of or connected with this Contract or Guest’s cruise, no matter how described, pleaded or styled, between the Guest and THE CIGAR CRUISE, LLC; DBA BASH & BURN, with the sole exception of claims brought and litigated in small claims court, shall be referred to and resolved exclusively by binding arbitration pursuant to the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York 1958), 21 U.S.T. 2517, 330 U.N.T.S. 3, 1970 U.S.T. LEXIS 115, 9 U.S.C. §§ 202-208 (“the Convention”) and the Federal Arbitration Act, 9 U.S.C. §§ 1, et seq., (“FAA”) solely in Kansas City, Jackson County, U.S.A. to the exclusion of any other forum. Guest hereby consents to jurisdiction and waives any venue or other objection that may be available to any such arbitration proceeding in Kansas City, Missouri. The arbitration shall be administered by National Arbitration and Mediation (“NAM”) under its Comprehensive Dispute Resolution Rules and Procedures and the fee schedule in effect at the time of initiating the proceeding with NAM, which are deemed to be incorporated herein by reference.
Guests that are provided the option to place a deposit will be billed for their balance due on or before January 15, 2019.
Any cancellations after January 15, 2020, up to March 15, 2020, will incur a 50% penalty of gross fare (inclusive of Taxes, Fees and Gratuities). All cancellations after midnight CST, March 15, 2020, are non-refundable. We encourage our guests to purchase travel insurance to minimize losses due to potential unforeseen cancellation circumstances.
THIS CONTRACT CONTAINS A BINDING ARBITRATION PREVISION WHICH MAY BE ENFORCED BY THE PARTIES.
